How short-term, long-term, and permanent injuries may affect your injury claim

The types of injuries an auto accident victim can sustain range from minor scratches to permanent damage, or even worse, a preventable death.

The amount of damages will differ not only types of injuries sustained, but also the period of time it takes a personal injury victim to fully recover. If the injury victim is able to fully recover from their injuries is also a significant factor in seeking compensation and damages.

Short-term Injuries: Injuries that that will heal within a few weeks or months, such as:

  • Superficial scratches or bruising;
  • Broken bones;
  • Injuries that require minor surgeries;
  • Injuries that can be corrected by a few weeks or months of physical therapy.

Long-Term Injuries: Injuries that may take a year or more to fully recover, such as:

  • Severe Head Trauma;
  • Nerve Damage;
  • Neurological Injuries;
  • Injuries that require multiple surgeries and/or medical procedures to correct.

Long-term Personal Injury typically are awarded higher levels of compensation and damages than that of Short-Term Injuries due to the increased severity of the injuries sustained, extended recovery periods, more time missed from work, and the additional elements relating to pain and suffering.

Permanent Injuries: Injuries where the victim will never fully recover and must live with some type of diminished quality-of-life for the rest of his or her life, such as:

  • Paralysis;
  • Loss of limb;
  • Permanent Brain Damage or Neurological Damage;
  • Permanent Physical Disfigurement;
  • Permanent Nerve or Muscular System Damage;
  • Permanent diminished or complete loss of eyesight or hearing;
  • Or any permanent disability.

Permanent Personal Injuries cases typically are awarded higher levels of compensation and damages than that of Long-Term Injuries due to the permanency of the injuries, any future or permanent medical treatment, medications, or support, the permanency of diminished quality of life, and any additional elements relating to pain and suffering.
